The Indian Homeowner's Interior Contract Checklist: 8 Must-Have Clauses & Milestone Payment Schedules

Published by Factography Research Team • Due Diligence Checklist • 10 min read

Every year, thousands of Indian homeowners face prolonged project delays, unauthorized material substitutions, and budget escalations of 30% to 50% over initial quotations. In nearly all cases, the root cause is identical: starting on-site carpentry work on informal WhatsApp chats, verbal promises, or vague one-page quotation estimates.

A formal interior execution agreement is not an expression of distrust—it is a binding project roadmap that protects both the homeowner and the design practice. Before transferring any token deposit, ensure your contract incorporates these 8 non-negotiable clauses.

The 8 Non-Negotiable Contract Clauses

1. The Itemized Bill of Quantities (BOQ) with Specific Brands

Reject lump-sum descriptions like "Master Bedroom Wardrobe: ₹1,80,000". The BOQ must explicitly detail:

  • Dimensions: Running feet or square feet of elevation (e.g. 7 ft width × 9 ft height).
  • Substrate Core: Specific plywood brand and grade (e.g. "CenturyPly Club Prime IS:710 Marine Grade BWP, 18mm thickness").
  • External Finish: Brand, code, and thickness (e.g. "Merino 1mm High-Gloss Laminate Code #1042").
  • Hardware Channels: Exact manufacturer specifications (e.g. "Hafele Matrix Box soft-close tandem drawers with 35kg load rating").

2. Fixed Handover Date & Liquidated Damages (Delay Penalty)

A contract without a fixed delivery date is an open invitation for delays. The agreement must state:

"The studio agrees to complete all physical execution and snagging handover within 75 calendar days from the date of site clearance. In the event of unexcused delays exceeding a 7-day grace period, the contractor shall credit the client liquidated damages of ₹750 per day of delay, capped at 5% of the total project value."

3. The Safe 10-40-40-10 Milestone Payment Schedule

Never agree to payment terms where 70% or 80% of project funds are disbursed before materials arrive at your site. We recommend the 10-40-40-10 milestone schedule:

Milestone Percentage Verifiable On-Site Trigger
Milestone 1 10% Booking deposit; 2D floor plans & 3D photorealistic render sign-off.
Milestone 2 40% Civil demolition complete; raw plywood, electrical conduits & carcass boards delivered to site.
Milestone 3 40% Carcasses installed; shutter lamination, false ceiling gypsum framing & primer painting complete.
Milestone 4 (Retention) 10% Final handover; paid 7 to 14 days after move-in once snag list items are rectified.

4. Written Variation Order (Change-Request) Protocol

Scope changes during site execution are common. Without a variation clause, contractors often perform verbal changes and submit an inflated surprise bill at the end.

Insist that any design alteration, electrical point addition, or material upgrade requires a signed Variation Order Form specifying the revised cost and timeline impact before work begins.

5. 12-Month Defect Liability Period (DLP Warranty)

Seasonal moisture changes in India cause plywood expansion and shrinkage during monsoons. The contractor must provide a written 12-month Defect Liability Period guaranteeing free rectification of:

  • Shutter warping or misalignment
  • Laminate bubbling or delamination
  • Hinge looseness and drawer slider jams
  • Plumbing joint seepage and electrical switch failures

6. Housing Society Compliance & Working Hours

High-rise housing societies enforce strict noise restrictions (typically no noisy drilling between 1:00 PM – 3:30 PM and on Sundays). The contract must explicitly obligate the contractor to abide by society guidelines, maintain service lift protection, and pay any fines resulting from contractor negligence.

7. Debris Removal & Post-Work Cleaning

Civil demolition generates hundreds of bags of rubble, gypsum scrap, and sawdust. The agreement must state that the contractor is responsible for daily site clearing and professional post-completion deep cleaning prior to final handover.

8. Dispute Resolution & Jurisdiction

Specify that any irreconcilable disputes shall be referred to an independent sole arbitrator under the Indian Arbitration and Conciliation Act, with legal jurisdiction situated in your city.
